  • 1<\/span>

    Laskuttamo.com service is provided by Laskuttamo Oy, Business ID: 3153503-2<\/p>\n<\/div><\/li>

  • 2<\/span>
    \n

    The user of the Laskuttamo.com service (hereinafter referred to as “user”) must accept these terms and conditions as binding before starting to invoice for any work or service. The user of the Laskuttamo.com service is the person performing the work or service. The user is a so-called light entrepreneur who performs paid work or services without being in an employment relationship within the meaning of the Employment Contracts Act. The contractor is the company that orders the work or service.<\/p>\n<\/div><\/li>

  • 3<\/span>
    \n

    In order to use the Laskuttamo.com service, you must create an account with Laskuttamo.com.<\/p>\n<\/div><\/li>

  • 4<\/span>
    \n

    There is no employment or service relationship between Laskuttamo Oy and the user under the Employment Contracts Act.<\/p>\n<\/div><\/li>

  • 5<\/span>
    \n

    The User and Laskuttamo Oy have agreed that Laskuttamo Oy will perform the tasks agreed in this agreement, which are related to the contract between the User and the Client, which are invoiced through the Laskuttamo.com service. In performing the agreed obligations, Laskuttamo Oy shall act only on the basis of this mandate. <\/p>\n

    The User shall also be responsible for all other obligations of the User in relation to the agreed assignment and the assignment contract between the User and the Client. The requirements may apply to the user and\/or the contractor (e.g. possible licensing requirements, qualifications or specific insurance for the activity, etc.).<\/p>\n<\/div><\/li>

  • 6<\/span>
    \n

    You may not invoice work covered by the Employment Contracts Act, nor may you invoice temporary work through the Laskuttamo.com service. The user must make it clear to the client that this is not an employment relationship with Laskuttamo Oy or between the user and the client. The user and the contractor shall conclude a contract for the work or service, the terms of which shall be agreed between the parties. It is the responsibility of the user to ensure that no employment relationship is created between the user and the sponsor.<\/p>\n

    The contractor may not pass on the right to assign the work to another company. The content of the work or service to be performed and the amount of the fee to be charged are a matter between the user and the contractor. <\/p>\n

    Laskuttamo Oy is not responsible for the contract between the user and the client in any way.<\/p>\n<\/div><\/li>

  • 7<\/span>
    \n

    You are entitled to be charged for work or services provided under the contract. The User shall invoice the Contractor using the Laskuttamo.com service. The User is responsible for the accuracy of all information provided. This applies, among other things, to the information provided on the invoice form in all its forms and to the declaration of tax-free reimbursements of expenses and other costs. The accuracy and acceptability of the invoices is always the responsibility of the user. Laskuttamo Oy shall always have the right to recover from the user any payments made on the basis of an incorrect invoice. <\/p>\n

    The user must be able to prove, where necessary, that the work has been carried out by the user in accordance with the contract of assignment between the user and the contractor, without any dispute, and that the assignment has not been made in breach of good faith or of the law.<\/p>\n

    Laskuttamo.com reserves the right to refuse to accept any invoice that is in violation of any law, governmental regulation, other Laskuttamo.com policies or contract.<\/p>\n<\/div><\/li>

  • 8<\/span>
    \n

    Once the invoiced amount has been paid by the Client to the Laskuttamo.com account, the payment will be made to the User as soon as possible, unless otherwise specified by the User. The settlement is subject to the User having provided all the information necessary to make the payment. <\/p>\n

    From the invoiced amount, the agreed withholding tax is deducted, as well as the service fee of Laskuttamo.com and other agreed fees.<\/p>\n

    Upon payment, the user will receive a payment invoice. The payment invoice is available on the Laskuttamo.com service.<\/p>\n<\/div><\/li>

  • 9<\/span>
    \n

    The user declares that he\/she is a taxable person in Finland for the work invoiced through Laskuttamo.com.<\/p>\n<\/div><\/li>

  • 10<\/span>
    \n

    The user registered with the Laskuttamo.com service is insured with accident insurance and liability insurance unless otherwise specified in the contract. The user can find out about the insurance policies and their terms and conditions on the Laskuttamo.com service <\/p>\n

    The User is responsible for ensuring that the User has adequate accident and liability insurance cover in the contract. (e.g. liability insurance has limitations on the scope of the industries not covered by liability insurance) In the event that Laskuttamo Oy’s insurance does not cover a possible damage, Laskuttamo Oy shall not be liable in any way for the damage caused to the user or the commissioning party.<\/p>\n<\/div><\/li>

  • 11<\/span>
    \n

    The User is not entitled to enter into credit, hire-purchase or subcontracting agreements on behalf of Laskuttamo Oy. The use of Laskuttamo Oy’s Business ID is prohibited for purchases exempt from VAT within the EU.<\/p>\n<\/div><\/li>

  • 12<\/span>
    \n

    If Laskuttamo.com has a claim against the user of the service under the terms of this agreement, Laskuttamo.com has the right to offset it against the user’s bills, if necessary.<\/p>\n<\/div><\/li>

  • 13<\/span>
    \n

    Laskuttamo.com takes care of the data protection and technical protection of the users of the service in accordance with the legislation in force. The user accepts the current data protection policy of Laskuttamo.com and the related register descriptions. The user is responsible for his\/her own customer register as the controller and for the accuracy and legality of the data in the register. Furthermore, the User is responsible for the fact that the User has the right to process the data, to submit them to Laskuttamo.com for processing and to grant Laskuttamo.com the right to process them.<\/p>\n<\/div><\/li>

  • 14<\/span>
    \n

    The user must comply with the law, regulations and official provisions. A person under a business ban is not entitled to use the Laskuttamo.com service.<\/p>\n<\/div><\/li>

  • 15<\/span>
    \n

    Laskuttamo Oy is not liable for any damages related to the contract between the user and the contractor. If Laskuttamo Oy has to pay damages to a third party or the commissioner due to the user’s fault or negligence or breach of contract, the user is liable for any damage caused to Laskuttamo Oy if he\/she breaches the contract or neglects his\/her obligations or causes damage intentionally or negligently. In the event of a dispute between the parties, Laskuttamo Oy’s liability is limited to the service fee charged to the user.<\/p>\n<\/div><\/li>

  • 16<\/span>
    \n

    These terms and conditions enter into force once the user has logged in to the Laskuttamo.com service and accepted these terms and conditions. The terms and conditions are deemed to be accepted at the latest after the user has started using the Laskuttamo.com service.<\/p>\n

    The terms of the contract are valid until further notice. The contract may be terminated by either party with 2 months’ notice.<\/p>\n<\/div><\/li>

  • 17<\/span>
    \n

    Laskuttamo.com has the right to make changes to this agreement at its discretion without the user’s prior consent. The changes will be effective from the time of the change. The user shall be deemed to have accepted the changes by continuing to use the Laskuttamo.com service.<\/p>\n<\/div><\/li>

  • 18<\/span>
    \n

    The User is not entitled to transfer the rights and obligations under these terms and conditions to a third party. Laskuttamo.com shall always have the right, without the User’s consent, to transfer the Laskuttamo.com service and all or part of the rights and obligations under these Terms to a third party of its choice.<\/p>\n<\/div><\/li>

  • 19<\/span>
    \n

    These Terms of Use are governed by Finnish law. All disputes, controversies and claims relating to these Terms of Use shall be resolved primarily by negotiation between the parties. If a dispute cannot be settled, the matter will be heard by the District Court of Helsinki.<\/p>\n<\/div><\/li>

  • 20<\/span>
    \n

    These terms of use are available in several languages.
